These terms govern the way in which you can and cannot use www.goldpass.co.uk. By using GoldPass.co.uk, you accept these terms.
Definitions
- 'Supplier' - Fubra Limited, a Company registered in England.
- 'User' - the party to which the service is provided.
1. Your use of GoldPass.co.uk
You alone are responsible for your use of GoldPass.co.uk and the
consequences of any such use. By using GoldPass.co.uk you agree to
comply with the following requirements:
(a) GoldPass.co.uk may not be used to send chain letters, junk mail, 'spam', solicitations (commercial or non-commercial) or bulk communications of any kind.
(b) You must not use GoldPass.co.uk or any part of GoldPass.co.uk in a way that might reasonably be expected to cause the same to be interrupted, damaged, rendered less efficient or which could in any way damage the operation of another's computer.
2. Intellectual Property
2.1 GoldPass.co.uk, its contents and all Rights therein are owned by
GoldPass.co.uk (and/or its licensors). "Rights" means copyright,
database rights, trade marks, design rights and other intellectual
and proprietary rights of whatever nature, anywhere in the world.
You acknowledge that (i) GoldPass.co.uk is protected by Rights; (ii)
these Rights are valid and protected in all media and technologies
existing now or later developed; and (iii) except as explicitly
provided otherwise, these Terms of Service and applicable copyright,
trademark and other laws govern your use of such Rights.
2.2 You may view, print, download or temporarily store extracts from GoldPass.co.uk for your personal, non-commercial reference without alteration, addition or deletion. You may not otherwise copy, reproduce, retransmit, distribute, publish, commercially exploit or otherwise transfer any GoldPass.co.uk material or content. You acknowledge that you will not acquire any Rights by downloading or otherwise using any GoldPass.co.uk content or materials.
3. Data Protection
3.1 The Supplier may place information concerning the User on a
computerised directory of internal use only. The Supplier will never
disclose a Users details to any third party unless required to by
law, unless specifically instructed to the contrary by the User.
3.2 In creating interfaces onto the World Wide Web, the Supplier enables either unlimited or secure access to information contained within the User's premises or computers. It is the responsibility of the User to define precisely the degree of security access to be enacted and the Supplier denies all liability both legally and for consequential damages and all forms of economic loss should commercial loss or damage occur as a result of unauthorised access to the User's computers.
4. Third Party Web Sites, Goods and Services
4.1 GoldPass.co.uk provides links to third party web sites that are
not affiliated with GoldPass.co.uk (although GoldPass.co.uk branding,
advertisements or links may appear on these sites). We make no
representations as to the quality, suitability, functionality or
legality of any sites to which we may provide links or any goods
or services available from such sites, and no such representations
should be inferred or construed whether from such provision or
otherwise.
4.2 All matters concerning any goods and services that you purchase from a third party site, including, without limitation all contract terms are solely between you and the owner of that site and GoldPass.co.uk will not be liable for any costs or damages to you or any third party arising directly or indirectly out of any third party website. You hereby waive any claim you might have against GoldPass.co.uk with respect to any such sites. The Contracts (Rights of Third Parties) Act 1999 shall not apply to this agreement.
4.3 Subject to the terms of our Privacy Policy, GoldPass.co.uk may, from time to time, send e-mail messages to you containing advertisements or promotions including links to third parties. GoldPass.co.uk makes no representation or warranty with respect to the quality, suitability, or functionality of any goods or services which may be obtained from third parties as a consequence of these e-mails, and you agree that GoldPass.co.uk shall have no liability with respect thereto.
5. Disclaimer of Warranties and Limitation of Liability
5.1 GoldPass.co.uk is provided on an "as is" and "as available"
basis. GoldPass.co.uk expressly disclaims all warranties or
representations of any kind, express or implied, to the fullest
extent permitted by law.
5.2 You understand and agree that GoldPass.co.uk does not warrant or guarantee the accuracy or completeness of any information in or provided in connection with GoldPass.co.uk. GoldPass.co.uk is not responsible for any errors or omissions or for the results obtained from the use of such information. Whilst GoldPass.co.uk is provided for the general information of the general public, all information is provided on the basis that GoldPass.co.uk, its employees and consultants, are not engaged in rendering legal, financial or other professional services or advice. Data and information in or provided in connection with GoldPass.co.uk should not be relied upon for any commercial or business transaction or investment or for any similar purpose.
5.3 GoldPass.co.uk shall not be responsible for any loss or damage caused directly or indirectly, by the information or ideas contained, suggested or referenced on GoldPass.co.uk. Your participation in GoldPass.co.uk is solely at your own risk. No advice or information, whether oral or written, obtained by you from GoldPass.co.uk or through GoldPass.co.uk shall create any warranty not expressly made in these terms of service or imposed by law.
6. Application performance
6.1 The Supplier shall use its best endeavours to create computer
software products as agreed to be purchased by the User and shall
offer a warranty as described herein. The Supplier warrants that the
product delivered to the User shall perform according to the logical
structure, which enables the processes therein to function
correctly. However the Supplier denies all liability for the timely
operation of the product when used within an Internet environment,
where the User or third party is providing the computer equipment
upon which the product is to reside or depend upon for any part of
its functionality.
6.2 By confirmation of contract with the supplier, the User specifically confirms his understanding that the timely operation of the Internet and world wide web is governed by constraints beyond the control of either party, and that the Supplier is not liable for perceived slow operation of an application written for the User, and accepts that from time to time the Supplier may offer advice upon amendments which may become necessary to improve the perceived speed of operation.
7. Trademark Notice
GoldPass.co.uk and the GoldPass.co.uk logo are trademarks of Fubra
Ltd.
8. Indemnification
You agree to indemnify and hold each of GoldPass.co.uk, its parents,
subsidiaries, affiliates, officers and employees, harmless from any
claim or demand, including reasonable legal fees, made by any third
party due to or arising out of your use of GoldPass.co.uk, the
violation of these Terms of Service by you, or the infringement by
you, or any other person, of your account, or of any intellectual
property or other right of any other person or entity.
9. Interpretation and Jurisdiction
These items shall be construed in accordance with English law and
the Supplier and the User shall submit to the Jurisdiction of the
English Courts.
10. Right to Assign
GoldPass.co.uk may assign its rights and obligations under these
Terms of Service and upon such assignment GoldPass.co.uk shall be
relieved of any further obligation under these Terms of Service.
Entry to the Lounges
All persons must be in possession of a valid flight ticket for the same day of
travel and outside the US, flight tickets must be accompanied by a valid boarding
pass for a departing flight, i.e. outbound passengers only. Please note some
lounges in Europe are located within designated Schengen areas of the airport
which means that access is only provided to these lounges if members are
travelling between Schengen countries. (Austria, Belgium, Denmark, Finland,
France, Germany, Greece, Holland, Iceland, Italy, Luxembourg, Norway, Portugal,
Spain and Sweden). Admittance to the Lounges participating in Lounge Pass is
conditional upon a valid Lounge Pass being presented at Reception by the customer
when entering a Lounge. Entry to each Lounge is only permitted on the date of
travel and for the number of persons shown on the Lounge Pass. Additional persons
may only be admitted to a Lounge at the discretion of the Lounge’s Reception staff
and will be charged an entry fee at the time where applicable. Lounge Pass
provides the holders with a maximum stay of 3 hours in the booked Lounge. For
extended stays, use of the Lounge is at the discretion of the Lounge staff and
any charge for an extension must be paid directly to the Lounge staff at the
time required. Children (where permitted) must be accompanied by an adult at
all times. Any infants or children causing upset to other users' comfort may be
asked to vacate the Lounge facilities. Lounge Pass allows you to include a maximum
of 5 passengers per booking (including where permitted infants and children). If
you have more than 5 passengers in your party or for a group booking please
contact us on UK +44 (20) 8253 5146 giving at least 7 days notice.
Lounge Rules
All persons entering a Lounge with a Lounge Pass must abide by the rules and
policies of that Lounge and must behave and dress in an orderly and correct
manner. Lounge staff have the right to refuse entry to any person who is
intoxicated or behaving in a disorderly fashion at their discretion and no
refund will be given for any Lounge Pass that cannot be used for this reason.
A Lounge Pass only provides the customer with admittance to a Lounge. All
facilities and refreshments that may be available inside any Lounge are provided
at the sole discretion of the Lounge’s managers and are outside Lounge Pass’
control. Lounge Pass shall not be held liable for either the non-provision of
any facilities and refreshments inside a Lounge or for the cost of any facilities
and refreshments that are provided and charged to any persons entering with a
Lounge Pass.
Cancellation & Refunds
A full refund of the Lounge Pass cost will be given for a cancelled lounge
booking where this is notified to Lounge Pass in writing by letter, fax or
email at least 24 hours prior to the departure date. The full Lounge Pass cost
will be refunded back to the credit/payment card used for the initial purchase.
No refund will be given for any cancellation notified to Lounge Pass less than
24 hours before the flight departure time and date. Lounge Pass reserves the
right to charge the customer’s designated credit card for the full cost of any
Lounge Pass where that Lounge Pass was previously cancelled and a refund made
to the customer and the cancelled Lounge Pass was subsequently presented at the
booked lounge and used to gain admittance by the customer and/or any other
persons shown on the cancelled Lounge Pass.
Liability
Any disputes on matters not relating to Lounge Pass that occur between Lounge
staff and any person entering with a Lounge Pass are to be settled by the
individual and the Lounge without recourse to the managers of Lounge Pass.
Lounge Pass shall not be held liable for any such disputes, which are outside
its control. Lounge Pass shall not be held liable for any loss or personal
injury suffered inside a Lounge by any person who has entered with a Lounge
Pass. Any loss or damage caused inside a Lounge by any person who has entered
with a Lounge Pass is the sole responsibility of that person and Lounge Pass
shall not be held liable for any costs of repair or compensation that are
rightfully payable by the person causing the loss or damage. Lounge Pass shall
not be held responsible for any direct or indirect loss incurred by a customer
or guest who misses their flight whilst visiting a lounge on a Lounge Pass.
